Worksite Agreement

New Castle County Department of Community Services and Youth Workforce Development Program Worksite Partner Agreement

This Agreement establishes a partnership between the New Castle County Department of Community Services (County) and the worksite partner (partner) to administer the Youth Workforce Development Program (YWDP).

 

I. Purpose and Scope of the Youth Workforce Development Program

New Castle County and its partners will prepare youth for participation in the labor force by providing meaningful work placements and training that will result in increased employment and earnings, increased educational and occupational skills credentials, and decreased welfare dependency, thereby improving the quality of the workforce and enhancing its productivity and competitiveness.

The Target Population for the Youth Workforce Development Program will be youth meeting the following eligibility criteria:

  • Is age 14-21
  • Is a low-income to moderate-income individual as defined by funding source requirements
  • Or, has been selected as a percentage of Youth Workforce Development Employees not required to meet income eligibility standards

 

II. Responsibilities

The partner organization will appoint a person to serve as the official contact and coordinator of all activities associated with carrying out this agreement. The partner will work directly with:

New Castle County will:

  • Develop service strategies for each participant that identifies work readiness, employment goals, appropriate achievement objectives and appropriate services for the participant.
  • Compensate youth participants at the wage of $15.00/hour.
  • Monitor and conduct on-site visits with youth and site supervisors.
  • Provide supportive services during the program.

 

Partner organization will:

  • Provide the following for each position:
    • Job descriptions
    • Responsibilities
    • Performance targets
  • Ensure that all direct supervisors where youth will be placed attend the employer orientation and training prior to the start of the YWDP program at their worksite.
  • Place youth in meaningful employment opportunities.
  • Help youth acquire the personal attributes, knowledge and skills needed to obtain a job by providing mentorship within the workplace.
  • Provide adequate supervision to ensure a safe and successful work experience.
  • Provide leadership development opportunities which encourage responsibility and other positive social behaviors.
  • Prepare and submit timely reports to the County as required, including, but not limited to: weekly timesheets, evaluations and surveys.
  • Comply with all State and Federal labor laws and standards.
  • Assist with payroll documentation including proofing for accuracy, approval, maintaining copies, and submission of timesheets every Friday by Noon.

 

III. Indemnification

Partner shall defend and indemnify and hold harmless the County of New Castle, its Departments, and their respective managers, officers, employees, board members, elected or appointed officials, agents and representatives, from and against all allegations, claims, actions, suits, demands, damages, liabilities, obligations, losses, settlements, judgments, costs and expenses (including without limitation reasonable attorneys fees and costs) which arise out of or relate to (1) death or bodily injury or (2) loss of or damage to personal and real property resulting from any negligent act or omission or willful misconduct of Partner or its directors, officers, employees, agents, stockholders, affiliates, and subcontractors.

 

IV. Insurance

(a)   Partner shall purchase and maintain the following insurance coverages solely at their expense for the term of this Agreement:

(i) Commercial general liability insurance which should include, but not limited to, coverage for liability for injury to persons, including death, and personal property, on an occurrence form with limits no less than $1,000,000 each occurrence and $3,000,000 annual aggregate.  Limits may be satisfied with a combination of primary, excess, and/or umbrella policies of insurance, provided that all such policies comply with all provisions of this Agreement.  Coverage shall include employment practices liability; and

(ii) Auto liability covering for all owned, non-owned and hired vehicles with limits no less than $1,000,000 combined single limit for bodily injury and property damage; and 

(iii) Worker?s Compensation insurance meeting statutory limits required by the laws of the state of Delaware, and under any other applicable state laws covering all persons employed or retained by them.

(b)          Duration of Insurance.  The insurance policies required by this Agreement shall be kept in full force and effect during the term of this Agreement.

(c)               Additional Insureds.  All insurance required under this contract except workers? compensation shall be provided on a policy(s) that specifically names the County, its officials and employees as additional insureds. 

(d)               Certificate of Insurance.  A certificate of insurance evidencing the coverage set forth in this Article is attached hereto as Exhibit __.  Partner shall provide the Community Services Manager with current certificates of insurance within five (5) business days of each renewal or change in policy throughout the term of this Agreement.  At the County?s request, Partner shall deliver the actual insurance policies to the County within five (5) business days. 

(e)               Subrogation.  All insurance required under this Agreement shall be provided on a policy that includes an endorsement that specifically waives any subrogation rights the insurer would otherwise have against the County, its officials or employees.

(f)                 Changes to Coverage.  Each policy shall be endorsed to require the insurer to give the County at least thirty (30) days? advance written notice of the insurer?s intention to cancel, refuse to renew, or otherwise terminate the policy, suspend or terminate any coverage under the policy, or reduce any policy limits, increase any policy deductibles, or otherwise modify or alter any terms or conditions of the policy or renewal issued by the same insurer.

(g)                Carrier Rating.  Each policy shall be written by a carrier licensed by the State of Delaware to do insurance business of the type involved in the State of Delaware, and which has, and maintains for the life of this contract, at least an ?A? rating from the A.M. Best Agency with ?Stable? outlook.  Any change in this rating or outlook must be relayed to the County by Partner or insurance carrier as soon as possible upon learning of same, and Partner shall use due diligence with its insurance broker or carrier to keep track of same.

(h)               Primary Insurance.  All insurance required under this contract except workers? compensation shall expressly provide that such insurance shall be primary insurance, and any similar insurance in the name of Partner shall be excess and non-contributing.

(i)                  Deductibles.  If any policy has a deductible or retention, Partner is solely responsible for the deductibles or retention and it will not make a claim against the County for any reimbursement, regardless of the cause of loss.  Deductibles for insurance provided under this contract shall not exceed five percent (5%) of policy limits.

(j)                  Notice.  Partner agrees to notify the County Attorney immediately, in writing, of any claim, demand or action arising out of an occurrence covered hereunder of which Partner has knowledge.

 

V. Terms of Agreement

This agreement is valid for one year from the below noted approval date. This agreement may be extended upon written mutual agreement. It shall be reviewed upon request by either party to ensure that it is fulfilling its purpose and to make any necessary revisions.

Either organization may terminate this agreement upon thirty (30) days written notice without penalties or liabilities.

 

VI. Authorization

Each person executing this Agreement represents that he or she has been duly authorized to do so by all requisite action on the part of the party on whose behalf he or she is signing, and that in so doing, he or she shall bind such party to all of the terms and conditions in this Agreement.
